1. Agreement to Terms
By accessing or using First FMCG Hub ("the Service"), including our WhatsApp community groups and website at firstfmcg.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.
These Terms constitute a legally binding agreement between you and First FMCG Hub regarding your use of the Service.
2. Description of Service
First FMCG Hub is a professional community platform that:
- Connects FMCG professionals through WhatsApp groups
- Enables members to post and discover business opportunities
- Publishes member listings to LinkedIn (Pro/VIP tiers)
- Provides access to industry intelligence and databases (VIP tier)
- Maintains community fraud alerts and verification
3. Membership & Eligibility
Eligibility Requirements
To join First FMCG Hub, you must:
- Be at least 18 years of age
- Be a professional working in the FMCG industry (supplier, buyer, distributor, brand owner, procurement, etc.)
- Provide accurate and truthful information during registration
- Have authority to enter into this agreement
Membership Tiers
- Basic (€10/month or €100/year): Community access, Requests feed, SCAM Alerts
- Pro (€25/month or €250/year): Basic features + listing submission + LinkedIn publishing
- VIP (€100/month or €1,000/year): Pro features + VIP badge + VIP & Admins group + industry databases
Free Trial
New members receive a 7-day free trial with PRO-level posting features. Access to Requests feed and SCAM Alerts groups requires a paid membership. You may cancel during the trial period without being charged.
4. Payment Terms
- All payments are processed securely through Stripe
- Subscriptions automatically renew unless cancelled
- Prices are in Euros (EUR) and include applicable taxes
- Annual subscriptions are billed once per year at a discounted rate
- No refunds for partial subscription periods after cancellation
Cancellation
You may cancel your subscription at any time through the Stripe customer portal. Upon cancellation:
- You retain access until the end of your current billing period
- You will be removed from community groups after access expires
- No partial refunds are provided
5. Community Guidelines
All members must adhere to the following rules:
Permitted Activities
- Posting legitimate FMCG product offers and purchase requests
- Professional networking and business discussions
- Sharing relevant industry news and insights
- Reporting fraudulent activity or suspicious members
Prohibited Activities
The following activities will result in immediate removal from the community without refund:
- Posting false, misleading, or fraudulent listings
- Spam, excessive self-promotion, or off-topic content
- Harassment, abuse, or disrespectful behavior toward members
- Sharing illegal products, counterfeit goods, or stolen merchandise
- Disclosing confidential community content to non-members
- Creating multiple accounts or sharing account access
- Scraping or harvesting member data
- Any activity that violates applicable laws or regulations
6. Listing & Content Guidelines
When posting listings, you agree that:
- All product information is accurate and truthful
- You have the right to sell or source the products listed
- Products comply with all applicable laws and regulations
- You will honor offers and commitments made to other members
LinkedIn Publishing
By submitting listings as a Pro or VIP member, you authorize First FMCG Hub to publish your listing content (product details, company name, contact information) on our LinkedIn page for extended reach.
7. SCAM Alerts & Fraud Reporting
The SCAM Alerts group is a community-maintained resource. While we strive to verify reports:
- We do not guarantee the accuracy of all fraud reports
- Members are responsible for conducting their own due diligence
- False or malicious fraud reports are prohibited and will result in removal
- First FMCG Hub is not liable for transactions between members
8. Intellectual Property
You retain ownership of content you post. By posting, you grant First FMCG Hub a non-exclusive license to:
- Display your listings within the community
- Publish listings to LinkedIn (Pro/VIP members)
- Use anonymized data for service improvement
The First FMCG Hub name, logo, and branding are our intellectual property and may not be used without permission.
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- The accuracy of member-posted content
- The outcome of any business transaction between members
- The legitimacy or creditworthiness of any member
10. Limitation of Liability
To the maximum extent permitted by law, First FMCG Hub shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Disputes or transactions between members
- Actions of any member, including fraud or misrepresentation
Our total liability shall not exceed the amount paid by you in the 12 months preceding any claim.
11. Indemnification
You agree to indemnify and hold harmless First FMCG Hub, its owners, employees, and affiliates from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you post or transactions you conduct
12. Termination
We reserve the right to suspend or terminate your membership at any time for:
- Violation of these Terms or Community Guidelines
- Fraudulent or illegal activity
- Non-payment of membership fees
- Any conduct harmful to the community or our reputation
Termination for cause is without refund. You may appeal termination decisions by contacting us.
13. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email or community announcement. Continued use after changes constitutes acceptance of the modified Terms.
14. Governing Law & Disputes
These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration.
